1. Interpretation
The following shall have the following meanings:
Client: the pet owner, veterinary practice or other agent of the pet owner whose order for the Services is accepted by Dignity Pet Crematorium.
Contract: an agreement for the supply of Services as may be described overleaf or otherwise agreed by the parties and shall include these terms;
Dignity: Dignity Pet Crematorium is the trading name of Dignity Pet Crematorium Ltd, a company incorporated and registered in England and Wales under company number 04317817 whose registered office address is at Brickfields, Odiham Road, Winchfield, Hook, Hampshire RG27 8BU.
Services: the services and/or the goods described in the Contract;
2. Contract
2.1. These terms shall apply to all supplies of the Services by Dignity to the Client. No order of the Client shall be binding and no Contract shall arise until the Client’s order is accepted by Dignity expressly or by Dignity supplying any of the Services. Each Contract shall comprise these terms, the terms overleaf, the terms for the Natural Woodland Area or Garden of Remembrance (if applicable) and any additional terms that are agreed. 2.2. If any Contract contains provisions which conflict with these terms, those provisions of the Contact will prevail.
3. Payment
3.1. The charges for the Services are as set out in the Contract and shall be inclusive of any VAT to the extent as stated in the Contact; otherwise VAT shall be payable in addition.
3.2. Payment shall be due on or before supply of the Services or at the times stipulated in the Contract.
3.3. The Client shall be responsible for any costs incurred in recovering late payments.
4. Risk and Property
Risk of loss or damage to any goods shall pass to the Client at the time of supply of the goods, but ownership of any goods shall pass to the Client only on receipt by Dignity of the charges in full (and VAT and other taxes and duties payable to Dignity) for the goods and other sums then due from the Client under all Contracts.
5. Abandonment
Dignity reserves the right to dispose of paid or unpaid goods (including but not limited to ashes) 6 months from the supply of the goods. Unclaimed ashes will be scattered in our Natural Scatter Area.
6. Code and Guarantee
6.1. Dignity will comply with the Code of Practice of the Association of Private Pet Cemeteries and Crematoria but if any of the Services do not conform to any applicable statutory or other warranties or other terms, Dignity will repair or replace those Services or make, so far as is fair, a refund of all or a part of the charges.
6.2. Dignity will only cremate one pet alone within an enclosed chamber and will collect the ashes before the next cremation. Dignity guarantees that the ashes sent to the Client or placed into the ground will be all and only those of the Client’s pet.
7. Force Majeure
Dignity shall have the right to suspend or cancel performance of the Contract to the extent that this has been caused by any circumstance beyond Dignity’s reasonable control, including amongst other things industrial disputes (whether or not involving employees of Dignity) or failure or delays by Dignity’s suppliers.
8. Transfers
Dignity may at any time assign, transfer, charge or deal in any other manner with any of its rights under the Contract, and may sub-contract any or all of its obligations under the Contract.
9. Governing Law and Jurisdiction
The Contract shall be construed in accordance with the law of England and Wales. The parties submit to the jurisdiction of the Courts of England and Wales.
10. Data Protection
Dignity will collect, hold and process personal data about you to provide our services to you. We will always process your personal data in accordance with all applicable data protection legislation and our Privacy Policy which can be viewed on the website at https://www.dignitypetcrem.co.uk/privacy-and-cookie-policy.
11. Product Returns & Refund Policy
We offer a full 30 day money back guarantee if you are dissatisfied at the quality of your product. For Alba Rose and See You jewellery please refer to their website for full terms and conditions.
If there is a defect with a Product or it is not as described which is our fault, we will offer a prompt repair, exchange or refund.
We are not at fault for any mistakes on a product where a proof as been provided to the client. Please check the spelling, wording, layout, font on your proofs prior to approval.
Headstone and gravestones have a warranty of 5 years at the discretion of the supplier. Pictures will need to be provided to us at Dignity for a full investigation. After 5 years we can offer the headstone/gravestones to be repainted at a cost, please enquiry with us for a price.
12. Pet Bedding Policy
You can choose to have blankets, toys and collars either cremated, disposed of or returned to you. We recommend you take away carriers, baskets and excess bedding when you bring your pet to us, however if they are left at Dignity, we will dispose of them or donate them to charity if they are not collected after three weeks of your pet being cremated. We are restricted regarding with we can cremate. When you discuss your wishes with our team, we will help guide you as to what can be cremated alongside your pet.
If you do choose to have bedding returned to you, please be aware that we do not have the facilities onsite to wash items for you. We will spray any bedding that has become heavily soiled with antibacterial deodorising spray before sealing the bag we return it to you in with a warning sticker on the outside. There is still a chance that the bedding could smell but you can choose to wash the bedding in bacterial washing solution which may remove any odours.
